Officials in Horn Lake, Mississippi, must approve a plan for the construction of the Abraham House of God mosque after a federal judge said local officials denying the first-ever mosque violated federal law.

According to WREG, The American Civil Liberties Union (ACLU) said they’ve secured a consent decree that orders the construction of the mosque. This decree comes after a lawsuit filed in November claimed Horn Lake alderman denied approval for the mosque, even though plaintiffs argued it was located in a house of worship area zone.

“We are heartened and relieved that we are able to move ahead with our plans for a mosque in Horn Lake, which will provide a critical local house of worship for my family and other Muslims in the community to gather and practice our faith freely and without discrimination,” said Plaintiff Riyadh Elkhayyat, co-founder of the Abraham House of God mosque, in a statement.

Now a federal district court will have continuing jurisdiction over the next five years to facilitate the enforcement of the consent decree, according to the ACLU.
